Introduction Darnell Peete (Petitioner) filed a Petition for Writ of Habeas Corpus along with Suggestions in Support and Exhibits, alleging that his attorney failed to file a direct appeal of Petitioner's convictions of rape, sodomy and child molestation. On February 5, 2009, we entered an Order to Show Cause to Respondent as to why Petitioner's Petition should not be granted. On February 17, 2009, Respondent filed his Response asserting that Petitioner should have filed a Rule 29.151 motion for post-conviction relief, as his attorney's failure to file an appeal is merely ineffective assistance of counsel. Petitioner timely filed his reply. Factual and Procedural Background On July 31, 1997, a jury found Petitioner guilty of four criminal charges in cause no. 961-1844, to-wit: one charge of rape; two charges of sodomy; and one charge of child molestation.
